This paper examines the discretionary reasoning of the judiciary in three jurisdictions, England, Germany and Norway, in cases deciding whether a newborn child is safe with her parents or intervention is necessary. Our analysis focuses on one specific dimension of decision makers' exercise of discretion, namely, if and how the strengths and weaknesses of the mother are considered. Abstract
The quality of parents' experiences with the child protection system (CPS) is related to the outcomes of their family's process in the system. The importance of collaboration with parents in child protection is underpinned by human and children's rights conventions addressing the right for family life and parents being first responsible in fulfilling children's rights. How do the structure and relational features of family networks affect refugees’ mental health after migration, particularly when refugees are geographically separated from their family?
